These Terms and Conditions ("Terms") govern your use of the Land Intelligence report service (the "Service"), operated by AI Software Factory, doing business through the Canopi Remote Sensing brand ("Company," "we," "us," "our"), a company organized in Wyoming, USA, with a registered address at 30 N. Gould Street Suite R, Sheridan, WY 82801.
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What the Service is (and is not)
The Service aggregates and presents publicly available geospatial and satellite data — sourced primarily through Google Earth Engine, and public datasets it provides access to (e.g., elevation models, land cover classifications, vegetation indices, historical fire/flood occurrence data, climate records) — for a location or land parcel you specify. We process this third-party data into a readable report (PDF/HTML) with summaries, visualizations, and scoring intended to make it easier to understand.
The Service does not perform any physical inspection, survey, or on-the-ground verification of any property. All information is derived remotely from satellite imagery and public datasets. We do not visit, inspect, measure, or verify any parcel in person.
2. Not professional advice
Nothing in a report, on our website, or in any communication from us constitutes financial, investment, legal, insurance, engineering, or real estate advice. Specifically:
- We are not financial or investment advisors. Nothing in a report should be interpreted as a recommendation to buy, sell, hold, develop, or invest in any property. Any "suitability score," "key takeaway," or executive summary language in a report is a simplified, automated interpretation of aggregated data — not a professional opinion, and not tailored to your individual financial situation.
- We are not licensed land surveyors, appraisers, geotechnical engineers, or other property professionals, and no report we generate is a survey, appraisal, geotechnical assessment, or any other form of licensed professional opinion or certification. Data such as elevation, topography, hazard history, or land cover is presented for informational context only and has not been verified by a licensed professional.
- We do not guarantee any parcel's suitability, safety, value, or legal status for any particular use.
Before making any financial, legal, construction, insurance, or purchasing decision involving real property, you should independently verify all information and consult a qualified, licensed professional (e.g., a licensed surveyor, appraiser, geotechnical engineer, attorney, or financial advisor) in the relevant jurisdiction.
3. Data accuracy and third-party sources
Report data originates from third-party providers (including but not limited to Google Earth Engine and the public agencies whose datasets it hosts). We do not control, and cannot guarantee the accuracy, completeness, timeliness, or fitness for any purpose of, this third-party data. Satellite-derived and remote-sensing data can be outdated, incomplete, affected by cloud cover or sensor limitations, or simply wrong.
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of accuracy, merchantability, fitness for a particular purpose, or non-infringement.
4. Limitation of liability
To the maximum extent permitted by applicable law, the Company, its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising out of or related to your use of, or inability to use, the Service — including any decision made in reliance on a report we generate.
Where liability cannot be fully excluded under applicable law, our total liability to you for any claim arising from the Service is limited to the amount you paid us for the report(s) giving rise to the claim in the twelve (12) months preceding the claim.
5. Acceptable use
You agree not to: (a) use the Service to violate any law; (b) attempt to access parcels or data outside the intended scope of the Service (e.g., scraping, automated bulk querying beyond normal use); (c) misrepresent a generated report as a licensed professional opinion (survey, appraisal, engineering assessment, etc.) to a third party; (d) interfere with or disrupt the Service's infrastructure.
6. Intellectual property
The Service, including its software, design, and report templates, is owned by the Company. The specific data compiled into a report you purchase is licensed to you for your personal or internal business use; you may not resell raw report data as a standalone data product without our written permission.
7. Changes to these Terms
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
8. Termination
We may suspend or terminate your access to the Service at our discretion, including for violation of these Terms.
9. Governing law
These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law principles.
